Terms of Service

Zukiru is operated by Zukiru Technologies (“we”, “us”). These terms are the agreement between you and us for your use of Zukiru. By creating an account or using the service you accept them. If you do not accept them, do not use Zukiru.

1. Who can use Zukiru

You must be at least 16 years old to have an account. You must also be able to form a binding contract where you live, and not be barred from using the service under the law that applies to you.

Registering does not by itself create an account. We email a six-digit code to the address you sign up with, and the account is created only when you enter that code — until then nothing is reserved for you, not the username and not the address. A registration that is never verified simply expires, and both stay available for someone else to register.

2. Your account

You choose a username and a password, and you are responsible for keeping the password secret and for everything done through your account. Tell us at once if you think someone else has access to it.

Every device signed in to your account appears under Sessions, along with the time it signed in. You can revoke any of them, or all of them but the one you are using, from that page. Changing your password does not automatically end other sessions, so revoke them yourself if you are worried about one.

3. Your content

You keep ownership of everything you post — your text, images and videos are yours. To run the service we need permission to handle them, so by posting you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical purposes such as resizing, and display your content in connection with operating and promoting Zukiru. This licence exists so we can show your posts to other people; it ends for new uses when you delete the content, subject to reasonable backup retention.

You confirm that you have the rights to everything you upload and that posting it does not break the law or infringe anyone else's rights.

4. Everything you post is public

Zukiru has no private accounts, no follower approval and no direct messages. Your profile, your posts, your replies, your reposts and your follower and following lists are visible to anyone, including people who are not signed in and search engines that index the site.

Uploaded images, videos and avatars are served from our media host by their id. Those addresses are not secret and not access-controlled: anyone who has the link can open the file, and it stays reachable while it is hosted, even after the post that used it is gone from view. Do not upload anything you would not want to be public.

5. Acceptable use

Do not use Zukiru to:

• post spam, run bulk or automated posting schemes, or manipulate the feed;
• harass, threaten, bully or abuse anyone;
• post sexual content involving minors, or non-consensual intimate imagery;
• post nudity or sexual content, or graphic violence;
• post anything unlawful, or that infringes copyright, trademark or privacy rights;
• impersonate another person, or misrepresent who you are in a way that misleads people;
• create accounts to get around a block, a suspension or a removal, or otherwise circumvent our enforcement;
• scrape, crawl or access the service by automated means outside our documented API, or attempt to interfere with, overload or gain unauthorised access to our systems.

6. Reporting and moderation

You can report a post or an account from the “···” menu on it. A report reaches us with the post or account attached, which makes it far more useful than an email. You can have one open report per post or account at a time.

We may remove or hide content, limit an account or suspend it, with or without notice, where we believe these terms have been broken or where the law requires it. We do not promise to review every report, or to review any of them within a particular time.

Blocking someone hides them from you and you from them. Note that from the outside, a blocked account is indistinguishable from an account that never existed or has been deleted — all three answer the same way — so you cannot use the service to determine whether a particular person has blocked you.

7. Reposting cannot be undone

You can repost any post once. There is no way to undo a repost from Zukiru: the service records that you reposted and refuses a second one, but gives the app no way to find the repost again in order to remove it. Treat a repost as permanent for as long as the original post exists.

8. Zubits and promoted posts

Zubits are Zukiru's in-app currency. You can get them by redeeming a gift code or by buying a pack, and spend them on avatar decorations and on promoting your posts. Zubits have no cash value, cannot be exchanged for money or transferred to another account, and are not refunded once spent, except where the law requires it.

You can promote your own original posts, not replies or reposts. A promotion buys a number of views: each time the post is served to someone as a promoted post counts as one, until the views you bought run out. A promotion cannot be cancelled, and promoting the same post again buys a second promotion rather than changing the first. If the post is deleted, by you or by us for breaking these terms, its promotion stops and any views not yet delivered are not refunded.

A promotion buys views, not an audience. Which promoted post a reader sees is picked at random from the promotions currently running, as our privacy policy explains, so we do not promise that your post will reach anyone in particular. A promoted post is still your post: everything in these terms about your content applies to it, and we may remove a promotion along with a post that breaks them.

9. Deleting your account

You can delete your account from Account settings. It takes your current password.

Deletion is immediate but reversible for a while. Your posts, replies, follows and media are hidden everywhere and every session is revoked at once. If you sign in again within 30 days, the account and all of its content come back. After 30 days that window closes. Your email address and username stay reserved by the deleted account either way and cannot be registered again, by you or anyone else.

10. The service may change or stop

Zukiru is a small service. We may add, change or withdraw features at any time, and we do not promise any level of availability or that your data will always be reachable. We may suspend or end the service altogether; where we can, we will give notice first.

11. Disclaimers

Zukiru is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, secure or error-free, or that content posted by other people is accurate or lawful. Content on Zukiru is posted by its users; we do not endorse it.

12. Limitation of liability

To the fullest extent permitted by Romanian law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, data or goodwill, arising from your use of Zukiru. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Where you deal with us as a consumer, your statutory rights are unaffected.

13. Changes to these terms

We may update these terms. When a change is material we will make a reasonable effort to tell you before it takes effect. Continuing to use Zukiru after a change means you accept the updated terms; if you do not, delete your account.

14. Governing law

These terms are governed by Romanian law, and disputes are subject to the competent courts of Romania. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may bring proceedings in your local courts.
